Terms and Conditions

DISCLAIMER: As with any fitness or exercise equipment, use of this equipment should only be used by persons who are physically able to use the equipment as it is designed for. Proper safety gear such as padded mats, shoes, clothing and the like should always be used. This equipment should not be used alone. Always have someone nearby in case of an emergency. Vita Vibe, Inc. and it's affiliates will not be liable for any injury or death resulting from use of this equipment. User assumes responsibility for proper assembly, maintenance, and use of this equipment.


These Terms and Conditions of Sale ("Agreement") contain the terms and conditions that apply to every order, purchase, receipt, delivery, or use of any products or services from Vita Vibe, Inc., dba VitaVibe.com, BalletBarreStore.com, or any of its subsidiaries or affiliates (collectively "Vita Vibe"). By purchasing from our site, you accept, and agree to be bound by, these terms and conditions. Any attempt to alter, supplement, or amend this Agreement or to enter an order for products(s) that is subject to altered or additional terms and conditions will be null and void, unless otherwise agreed to in writing signed by both you and Vita Vibe. These terms and conditions are subject to change without notice at Vita Vibe's sole discretion.

1. Definitions

  1. "We", "us" and/or "our" means Vita Vibe, Inc., dba, VitaVibe.com, BalletBarreStore.com, or any of its subsidiaries or affiliates (collectively "Vita Vibe").
  2. "You", "Your" and/or "Customer" means the individual(s) or entity/entities identified on the Order Confirmation.

2. Payment Terms, Orders, Quotations.

Advertised prices are in US Dollars and, unless otherwise noted, exclude shipping, handling, and any taxes that may be imposed by the governmental authority of the jurisdiction in which you reside and/or work. Unless otherwise agreed to by Vita Vibe, your order is not accepted by us until your payment has been received by us in full. Until full payment is received, your order is not binding on us, and any price quotation from Vita Vibe is subject to change at any time without notice. We reserve the right to reject or cancel any order at our sole discretion. We reserve the right to prosecute fraud to the full extent of the law including but not limited to credit card fraud and check fraud. Vita Vibe is not responsible for pricing errors, typographical and other like errors and reserves the right to cancel any orders resulting from such errors.

3. Products.

We continually upgrade and revise our products. Vita Vibe may revise and discontinue products at any time without prior notice to its customers.

4. Processing Times.

Processing times start upon payment authorization and do not include in-shipping transit period. It is our responsibility to maintain direct communication with customer regarding any delays of which we are aware. We are not responsible for lack of communication from a customer which delays order processing.

5. Shipping Charges, Taxes, Title, Risk of Loss.

Shipping and handling are additional charges unless otherwise expressly indicated at the time of sale. Shipping dates are best estimates. Customer is responsible for any duty taxes assessed by customs. Title to the product(s) passes to you and risk of loss passes to you when the product(s) are delivered to the address you designate. Loss or damage that occurs during shipping from Vita Vibe to customer by a carrier selected by Vita Vibe is the responsibility of the carrier. It is our responsibility to insure the shipped product and file claims with the insurer and/or the carrier should damage or loss occur. If you receive a shipment containing damaged product(s), or if you receive a shipment containing less than all product(s) you ordered, you must notify Vita Vibe and make a claim within five (5) calendar days of such receipt. After we confirm the validity of such claim, we will (a) in the case of damage or loss of product(s) during transit, file a claim with the insurer and/or the carrier, and (b) in the case of incomplete shipment that is our responsibility, ship the remainder of ordered product(s) to you. Unless you provide us with a valid, complete and accurate tax exemption certificate applicable to your purchase of product(s) and the product(s) ship-to location, you are responsible for sales and other taxes associated with the order.

6. Product Return.

All products may be returned for a refund or exchange within thirty (30) days from date of receipt, unless otherwise indicated. For all returns, the customer must call Vita Vibe at 864-288-8934 for return instructions and to obtain an (RMA#) return authorization number. Buyer is responsible for all return shipping costs. All products must be returned in new condition in its original packaging or packaging that will afford the same level of protection as the original packaging.

Poorly packaged or damaged products will incur an additional 15% damage fee. Original shipping charges, if any, are non-refundable. Proof of purchase is required in all cases.

Special and custom products are non-returnable and non-refundable except in the case of a manufacturer’s defect in materials or workmanship.

All personalized products are subject to a 15% restocking fee.

All permanent mounted products (wall mounted and floor mounted products) will be subject to a 30% restocking fee unless returned in new, unused condition.

7. Warranty

Vita Vibe, Inc. warrants its products against defects in materials and workmanship for a period of ten (10) years from the date of original purchase.

Exclusions to this warranty include decorative finishes, wood barres, and damage caused by abuse or misuse outside the range of normal usage. This warranty also does not cover damage due to accident, negligence, or modification of any part of the product.

This warranty is in effect to the original purchaser only. In the unlikely event of a warranty claim, the purchaser is responsible for obtaining a Return Authorization Number (RMA) from Vita Vibe, Inc. and shipping the defective unit prepaid to the address shown on the RMA. Product must be packaged in its original packaging or packaging affording an equal degree of protection.

Vita Vibe, Inc. will repair or replace the defective unit and ship prepaid back to purchaser. Vita Vibe, Inc. reserves the right to select return shipping carrier and method. At its option, Vita Vibe, Inc. may replace defective unit with a replacement unit that is considered equal or superior to defective unit.

Repair or replacement as provided under this warranty is the exclusive remedy of the consumer. Vita Vibe, Inc., BalletBarreStore.com, or any of its subsidiaries or affiliates (collectively "Vita Vibe")., shall not be liable for any incidental or consequential damages for breach of any expressed or implied warranty on this product. Except to the extent prohibited by applicable law, any implied warranty or merchantability or fitness for a particular purpose on this product is limited in duration to the duration of this warranty.

Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitation on how long an implied warranty lasts, so the above limitations or exclusions may not apply. This warranty gives you specific legal rights, and you may have other rights which vary from state to state.

Use of this product constitutes acceptance of these terms and conditions of warranty.
